Terms of Service

By creating an account or using PitchWon at pitchwon.com ("the Service") you agree to these Terms of Service and our Privacy Policy. These terms form a legally binding agreement between you and PitchWon.

We may update these terms at any time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated terms.

PitchWon is an AI-powered software-as-a-service platform that helps freelancers generate professional proposals and contracts. The Service includes AI proposal generation, AI contract generation, proposal and contract management, Win Intelligence analytics, and PDF and text export.

Important AI Disclosure: PitchWon uses large language model artificial intelligence to generate proposal and contract content based on your inputs. In accordance with applicable AI transparency regulations including the EU AI Act, we disclose that all proposal and contract output is machine-generated by an AI system. You are always interacting with an AI-powered tool, not a human writer. All AI-generated content requires your review before use.

You must be at least 18 years old to use the Service. By creating an account you confirm that you meet this requirement and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@pitchwon.com if you become aware of any unauthorised access to your account.

One person may not maintain more than one free account. Account sharing is not permitted except where explicitly allowed under an Agency plan.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Generate proposals or contracts intended to deceive, defraud, or mislead clients or any third party
• Impersonate any person, entity, or brand in proposals generated through the Service
• Use the Service to create content that violates any applicable law or regulation
• Attempt to reverse engineer, decompile, copy, scrape, or extract the underlying technology of the Service
• Use automated scripts, bots, or tools to access the Service beyond permitted API limits
• Resell, sublicense, or commercially redistribute the Service or its outputs as a standalone product without our written consent
• Upload or transmit malware, viruses, harmful code, or any content that could damage the Service or other users
• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems
• Use the Service in any manner that could disable, overburden, or impair the Service

We reserve the right to suspend or permanently terminate accounts that violate these rules without prior notice.

Ownership: You retain full ownership of all proposals and contracts generated through the Service using your inputs. PitchWon does not claim ownership of your generated content.

Licence to us: By using the Service you grant PitchWon a limited, non-exclusive, royalty-free licence to process your inputs including job descriptions and profile information solely to generate your requested output and to provide and improve the Service. We do not use your specific proposal content to train AI models.

Your responsibility: AI-generated proposals and contracts are provided as starting points and drafts only. You are solely responsible for reviewing all AI-generated content before sending it to clients or entering into any agreement based on it. You are responsible for ensuring the accuracy, completeness, and appropriateness of all content for your specific situation and jurisdiction.

No legal advice: AI-generated contracts are not a substitute for professional legal advice. For high-value, complex, or regulated engagements we strongly recommend consulting a qualified legal professional before using any AI-generated contract.

No guarantee of results: PitchWon does not guarantee that using AI-generated proposals will result in winning freelance contracts, increasing win rates, or achieving any specific business outcome. Results vary based on many factors outside our control including client preferences, market conditions, and the quality of your freelance services.

EU AI Act compliance: PitchWon operates in compliance with applicable AI transparency requirements. Our AI system is not used for prohibited purposes under the EU AI Act. Users are always informed they are interacting with an AI-powered tool.

Free Plan: Includes 3 proposals per month at no cost. No credit card required.

Paid Plans: Pro and Agency plans are available on monthly or annual billing cycles. Prices are displayed on our Pricing page at pitchwon.com/pricing.

Indian users: Subscriptions are billed in Indian Rupees (INR) and processed by our Indian payment processor. Prices are subject to applicable GST which will be added at checkout.

International users: Subscriptions are billed in US Dollars (USD) and processed by our international payment processor acting as merchant of record. All applicable taxes are handled by our payment processor.

Billing: Subscriptions are billed in advance on a monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

Price changes: We will give you at least 30 days notice of any price changes. Price changes take effect at your next renewal date.

Failed payments: If a payment fails we will notify you by email. If payment is not resolved within 7 days your account will be downgraded to the Free plan. Your data will be retained and your account can be reactivated by updating your payment method.

Annual plans: Annual subscriptions are billed in full at the start of the subscription period. Annual plans are non-refundable after the 14-day refund period except as required by applicable law.

We offer a 14-day money-back guarantee on all paid plans. If you are unsatisfied for any reason within 14 days of your first payment contact us at support@pitchwon.com for a full refund with no questions asked.

After 14 days all payments are non-refundable. We do not provide partial refunds for unused time remaining in a billing period following cancellation.

Refunds are processed within 5 to 10 business days and returned to your original payment method.

Abuse of our refund policy including repeatedly subscribing and requesting refunds may result in account termination.

You may cancel your subscription at any time from your account Settings page or by contacting support@pitchwon.com. Upon cancellation your access to paid features continues until the end of your current billing period. After the billing period ends your account reverts to the Free plan. Your data is retained for 30 days after cancellation and then permanently deleted. You may export your proposals and contracts before deletion.

Our IP: PitchWon, its name, logo, software, design, user interface, and underlying technology are owned by PitchWon and protected by applicable intellectual property laws. You may not use our branding, trademarks, or technology without our prior written consent.

Your content: You retain full ownership of all content you input into the Service and all proposals and contracts generated through the Service. Nothing in these Terms transfers ownership of your content to us.

Feedback: If you provide feedback, suggestions, or ideas about the Service you grant us the right to use this feedback without restriction or compensation to you.

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, PitchWon disclaims all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant that AI-generated proposals or contracts will be accurate, appropriate, legally valid, or effective for your specific situation. We do not warrant that use of the Service will result in any specific business outcome including increased win rates or revenue.

To the maximum extent permitted by applicable law, PitchWon and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of revenue, loss of contracts, loss of data, or business interruption arising from your use of or inability to use the Service.

Our total cumulative liability to you for any claims arising from or related to the Service shall not exceed the greater of the total amount you paid us in the three months immediately preceding the claim or USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless PitchWon and its owner from and against any claims, damages, losses, liabilities, costs, and expenses including reasonable legal fees arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any proposals or contracts you enter into based on AI-generated content from the Service.

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for service interruptions caused by factors outside our reasonable control including third-party infrastructure failures, internet outages, or force majeure events.

The Service may contain links to third-party websites or integrate with third-party services. We do not control these third parties and are not responsible for their content, privacy practices, or terms. Your use of third-party services is governed by their respective terms and policies.

We may suspend or terminate your access to the Service at any time with or without notice if we reasonably believe you have violated these Terms or if required by law. Upon termination your right to use the Service ceases immediately.

You may terminate your account at any time as described in Section 8. Sections 7, 9, 10, 11, 12, and 16 survive termination of these Terms.

These Terms are governed by the laws of India including the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, and other applicable Indian laws. For users in the European Economic Area, applicable EU consumer protection laws also apply and are not affected by this clause.

We encourage resolution of disputes through direct communication first. Contact us at support@pitchwon.com and we will attempt to resolve any issue within 30 days. If a dispute cannot be resolved amicably it shall be subject to the exclusive jurisdiction of competent courts in India.

For EEA consumers: Nothing in these Terms affects your statutory rights under applicable EU consumer protection legislation including your right to bring claims before courts in your country of residence.

These Terms together with our Privacy Policy constitute the entire agreement between you and PitchWon regarding the Service. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision does not constitute a waiver of that right. You may not assign your rights under these Terms without our consent. We may assign our rights and obligations under these Terms without restriction.
